This Home Banking Agreement ("Agreement") is between Fort Lee Federal Credit Union (hereinafter "we, us, our or Credit Union"), and each member who has enrolled in our Home Banking service, together with any person who is authorized by a member to use or access their Home Banking Service (hereinafter referred together as "you, your or yours").
The Credit Union's Home Banking and Bill Payment Services are additional "electronic" service provided to increase the convenience to our members. Our Internet address is www.fortleecu.org. This Agreement supplements the other terms and conditions set forth in the Credit Union's Membership, Account and Account Service Agreement and Disclosures (the Membership Agreement"), which you have previously received and agreed to.
You understand that by signing an application, completing and submitting an application on-line, using or continuing to use these services, you agree to the terms and conditions of this Agreement.
You warrant and agree that you will not use Credit Union accounts or services, including but not limited to loans, to make or facilitate any illegal Transaction(s) as determined by applicable law; and that any such use, including any such authorized use, will constitute an event of default under this Agreement. You agree that the Credit Union will not have any liability, responsibility or culpability whatsoever for any such use by you or any authorized users(s). You further agree to indemnify and hold the Credit Union harmless from any suits, liability, damages or adverse action of any kind that results directly or indirectly from such illegal use.
  1. "Access Device" means any ATM card, debit card, or other electronic access device and/or any codes, passwords or personal identification number that we issue to allow you to access and/or use any account or other service.
  2. "Authorized User" means any person who has actual, implied or apparent authority, or who any owner has given an information, access device or documentation that enables such a person to access, withdraw, make transactions to or from your accounts, or to use any of your account services. This definition is intended to be construed broadly and includes without limitation all users acting under a written document such as a power of attorney as well as any person or entity that is authorized to make deposits or debits to or from your accounts with us.
  3. "Bill Payment" means our service that allows you to pay or transfer funds to designated Payee(s) in connection with our Bill Pay service.
  4. "Business Day" means Monday through Friday from 9am to 5pm, excluding Holidays.
  5. "Payee" means any individual, financial institution, educational institution, company, merchant or other person or entity that you wish to pay using the Bill Pay Service.
In order to enroll and activate Home Banking Services with us, you must be eligible to maintain an account with us. To determine your eligibility for Home Banking Services, now and in the future, you authorize us to make inquiry to determine your employment history and to obtain information concerning any accounts with other institutions and your credit history, including consumer credit reports.
To use the Credit Union's Home Banking Services, you must use a personal computer or other device with the capacity to interface by modem or otherwise with the Credit Union's or our agent's system. The Credit Union is not responsible for providing any equipment, services or advice related to equipment necessary to interface with our system, and is not responsible for any error in connections, transmissions or otherwise regarding any system, software, entries or instructions.
When using the Credit Union's Home Banking Services, you must, when prompted, enter your User ID and Security code. By entering the correct information you will have direct access to your Credit Union accounts.
You should keep your password or pin in a secure location. Any person having access to your Home Banking password or PIN will be able to access the Home Banking Services and perform all transactions, including reviewing Account information.
Home Banking Services are generally accessible 24 hours, seven days a week, except that Home Banking services may be inaccessible for a reasonable period for system maintenance.
We may modify, suspend, or terminate access to the Home Banking services at any time and for any reason without notice.
You acknowledge and agree that the Internet is considered inherently insecure. Therefore, you agree that we have no liability to you whatsoever for any loss, claim or damages arising or in any way related to our response(s) to any e-mail or other electronic communication, which we in good faith believe you have submitted to us. We have no duty to investigate the validity or to verify any e-mail or other electronic communication; and may respond to e-mail at either the address provided with the communication or the e-mail address in your Membership Application and Signature Card. Although having no obligation to do so, we reserve the right to require authentication of e-mails or electronic communications. The decision to require authentication is in the sole discretion to the Credit Union. We will have no obligation, liability or responsibility to you or any other person or company if we do not act upon or follow any instruction to us if a communication cannot be authenticated to our satisfaction.
By accepting the digital version of this Agreement, you agree that We may make agreements with you to provide services through digital means. You provide your authorization and informed consent to receive notices and records via digital means as described in this Agreement. All agreements entered into by digital means will be deemed valid, authentic, and shall have the same legal effect as agreements entered into on paper. You will be deemed to have received any digital messages sent to you if such messages are sent to the latest email address you have provided to Us or to your Home Banking message inbox.
You further agree that digital copies of your account statement are valid as "originals" and you will not contest the validity of the electronic copies, absent proof of altered data or tampering. This consent to the use of digital agreements and communications shall apply to all agreements and communications made in conjunction with this Agreement and the Service.
By accepting the terms and conditions of this Agreement, you represent and warrant that you are authorized to do so.
In the event you wish to receive copies of this or other electronic record on paper, please contact us by visiting a branch, writing to us at 4495 Crossings Blvd, Prince George VA 23875, or calling us at 804-452-0736. At any point you may withdraw your consent to receive disclosures and notifications electronically, you will not be charged a fee if you choose to terminate receipt of notifications and/or disclosures via electronic means.

For technical assistance, please contact your Internet Service Provider.
  1. Review transactions on your account
  2. Transfer money between Shares, Share Draft and other internal accounts*. (Must be joint on the account)(Limitations may apply).
  3. See a summary of your account.
  4. Transfer payments to your credit union loans, or Christmas club account.

We can process a funds transfer on the same Business Day as your Home Banking session. For purposes of these disclosures, Ft Lee FCU business days are Monday through Friday, excluding holidays. If you schedule a one-time transfer, for a future date, we process that transaction after 2:00 on that date. EXCEPTION: If the scheduled transfer date is other than a business day.
When you schedule a funds transfer using the Home Banking service, you authorize us to withdraw the necessary funds from your account. We deduct the amount of your funds transfer from your account on the date we process your instructions.
We process fund transfers only if there are sufficient funds available in your account. If sufficient funds are not available in your Account on the date a loan payment/transfer is scheduled to be made, the transfer will not be processed and it is your responsibility to check your account.
You authorize Fort Lee Federal Credit Union to utilize Fiserv to provide the Services to You on Our behalf. In order to use Bill Pay, you must have a Fort Lee Federal Credit Union checking account. You will be able to use the Bill Pay service 24 hours after you have enrolled, excluding weekends and holidays
Payment of Taxes or Court directed payments and payment to payees outside the United States via the Services is prohibited.
We reserve the right to refuse to make any payment and/or transfer.
Subject to the terms and conditions of this Agreement, You authorize Us, and any third party acting on Our behalf, to choose the most effective method to process Your payment and/or transfer, including, without limitation, electronic, paper or some other draft means. For each properly instructed payment to an eligible Merchant and/or transfer to a targeted Account You will receive a transaction confirmation number (Confirmation Number).
The Payment Date indicated by You must always be a Business Day (as defined above). If it is not, the Payment Date will be deemed to be the first Business Day before or after the date indicated. Schedule your payment to a Merchant at least five (5) business days before the due date.
We shall not be liable for any failure to make a payment and/or a transfer, including any finance charges or late fees incurred as a result. It is also important that the payment date be scheduled before the merchant due date, not the late date, and since the time for us to process your payment varies according to the particular merchant, You must become familiar with the payment processing time for each merchant you desire to pay, and allow the appropriate number of business days between the day You input your payment instruction and the payment date.
The business date of the payment, which will be debited from Your account at 2:00 p.m. EST, is not included in the five business day period required for processing the transaction. Subject to the limitation discussed below, if You follow the procedures described in this agreement for payment and the bill payment processor has made an error, we will reimburse you for that late charge up to a maximum of fifty dollars ($50.00) if you are assessed a penalty or late charge in the event that you do not adhere to the obligations set forth in this agreement, or You schedule a payment less than the number of business days before the due date required for a particular merchant, the bill payment processor and the credit union will not guarantee the timely delivery of any non-electronic payment (check) that is mailed to the merchant due to the fact that the credit union and the bill payment processor has no control of the United States Postal Service. You will bear full responsibility for all penalties and late fees and we will not be liable for any such charges or fees. The Service assumes no liability for the late posting or misapplication of payment once funds are received by merchants. This absence of liability, however, does not preclude the credit union from working to resolve these types of issues when they arise.
If a payment is processed in the form of a check rather than an electronic funds transfer, the Credit Union and the payment processing vendor may not be held liable for the timely delivery of said item by the United States Post Office. Payment of any late fees incurred by the transaction are subject to the aforementioned requirements in this agreement. After the 5th business day has past from the process date of the transaction, a payment investigation may be requested. A payment investigation may occur on the 6th business day from the transaction and involves a seven to ten business day investigation period. During which time, the payment processor will be in contact with the merchant in question.
Except for those transfers which are completed immediately, You may cancel or modify a scheduled payment and/or transfer up to 2:00 p.m. Eastern Standard Time (EST) on the same business day.
If a stop payment is requested by the member after the 5th business day, there is a 2 business day waiting period to confirm the stop payment has occurred. After the two business day period has past, the member's account will be credited back within 3 to 6 business days. Limitation: Under no circumstances will We be liable if We are unable to complete any payments and/or transfers initiated in a timely manner via the Services because of the existence of any one or more of the following circumstances:
  1. You do not obtain Confirmation at the time You initiate a payment and/or transfer.
  2. The designated Account does not contain sufficient funds to complete the payment and/or transfer.
  3. You have closed the designated Account.
  4. We have identified You as a credit risk and have chosen to (i) make all payments and/or transfers initiated by You via the Services utilizing a paper, as opposed to electronic, method, or (ii) to terminate Your subscription to the Services.
  5. The Services, Your equipment, the software, or any communications link is not working properly and You know or have been advised by Us about the malfunction before You execute the transaction.
  6. You have not provided Us with the correct information for those Merchants to whom You wish to direct payment or Accounts to which You wish to make a transfer.
  7. The Merchant mishandles or delays handling payments sent by Us.
  8. Circumstances beyond our control (such as, but not limited to, fire, flood, or interference from an outside source) prevent the proper execution of the transaction and We have taken reasonable precautions to avoid these circumstances.
You will receive a monthly account statement from us, unless there are no transactions in a particular month. In any case, you will receive an account statement on all of your accounts at least quarterly.
Federal Regulation requires us to limit either by contract or in practice the number of certain types of transfers from savings (shares). Under these regulations you are limited to six (6) preauthorized electronic fund transfers and telephone transfers-including Home Banking transactions, checks and point -of-sale transactions per month. Of these six transactions, you are limited to no more than three transactions per month by check or point-of-sale. Each fund transfer or payment through Home Banking services from your savings (shares) account is counted as one of the six limited transfers you are permitted each month. However, payments to your loan accounts with us are not counted toward this limit for savings (share) accounts.
Fees: For savings/share accounts an excess transaction fee may apply to each withdrawal made through Home Banking Services that exceeds the number of limited transactions permitted by Federal regulations each statement period described in your account agreement.

Bill Payment Service: No charge
Stop Payment: $25.00 per request
Research: $15.00 per request
The member must request the stop payment in writing, and the $25.00 stop payment fee will be deducted from the members checking account.
A $15.00 research fee will be charged if a member initiates a 3rd party investigation. You must notify Fort Lee Federal Credit Union to initiate the process. If the credit union or bill payment processor is in error, the fee will be waived.
You should notify us immediately if you believe your PIN has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account. To notify us call 1-804-452-0736, Monday through Friday 9am to 5 pm, contact us electronically by sending a message through the Credit Union's e-mail, memberservices@fortleecu.org* or write: Fort Lee Federal Credit Union, 4495 Crossings Blvd, Prince George, VA 23875.
Federal law requires that if you believe your PIN has been lost or stolen, and you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50 if someone used your PIN without your permission.
Please tell us AT ONCE if you believe your PIN has been lost or stolen. Telephoning us at 1-804-452-0736 or sending us e-mail at memberservices@fortleecu.org* are the best ways of keeping our possible losses down. If you do not notify us promptly, it is possible that you could lose all the money in your Account. If you tell us within two (2) business days, you could lose no more than $50 if someone used your PIN without your permission.
If you do NOT notify us within two (2) business days after you learn of the loss or theft of your PIN, and we can prove that we could have stopped someone from using your PIN without your permission if you had told us, you could lose as much as $500.
Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the FIRST statement showing such a transfer was mailed to you, you may not get back any money, you lost after the 60 days, if we can prove that we could have stopped someone from taking the money if you had told us in time. Your role is extremely important in the prevention of any wrongful use of your account. You must promptly examine your account statement upon receipt. If you find that your records and ours disagree, you must call 1-804-452-0736 or e-mail memberservices@fortleecu.org* us immediately.
Please provide the following information:
  1. Tell us your name and account number.
  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is in error or why you need more information.
  3. Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 BUSINESS DAYS. We will tell you the results of our investigation within 10 BUSINESS DAYS after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 DAYS to investigate your complaint or question. If we decide to do this, we will re-credit your account within 10 BUSINESS DAYS for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 BUSINESS DAYS, we may not re-credit your account.
If we fail to complete a transfer to or from your account on time in the correct amount according to our agreement with you, we will be liable for your losses or damages. However there are some exceptions:
  1. If, through no fault of ours, you do not have enough money in your Account to make the transfer.
  2. If the funds in your Account were attached or the transfer cannot be made because of legal restrictions affecting your Account; 3. If circumstances beyond our control such as interruption of telephone service or telecommunication facilities, or natural disaster (such as a fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
This section discusses the use of the Mobile Money Services ("Services") and any related Software ("Software") provided by Fort Lee FCU ("Financial Institution") combined with your handheld's text messaging capabilities. By participating in the Services or using the Software, you are agreeing to the following terms and conditions, in addition to any terms and conditions to which you have previously agreed with respect to the underlying electronic banking, remote deposit and bill pay services of which the Service is a part. Fort Lee FCU in its discretion may modify these Terms and Conditions at any time. Standard messaging charges apply.
Terms and Conditions
a. Program: Fort Lee FCU offers their members mobile access to their account information (e.g., for checking balances and last transactions) over the Short Message Service (SMS), as well as the option to set up alerts for their accounts (e.g., low balance alerts). Enrollment requires identification of the user's banking relationship with Fort Lee FCU as well as providing a mobile phone number. The mobile phone number's verification is done by the user receiving an SMS message with a verification code which they will have to enter on the website. Additionally, members may select the type of alerts and other preferences which will determine, together with their account data, the frequency of alerts delivered to the member. This program will be ongoing. Standard messaging charges apply. Members will be allowed to opt out of this program at any time.
b. Questions or in the event you wish to receive copies of this or other electronic record on paper, please contact us by: visiting a branch, writing to us at 4495 Crossings Blvd, Prince George VA 23875, emailing to memberservices@fortleecu.org or calling us at (804) 452-0736. We can answer any questions you have about the program. At any point you may withdraw your consent to receive disclosures and notifications electronically, you will not be charged a fee if you choose to terminate receipt of notifications and/or disclosures via electronic means.
c. To Stop the program: To stop the messages from coming to your phone, you can opt out of the program via SMS. Just send a text that says "STOP" to this number: 25215. You'll receive a one-time opt-out confirmation text message. After that, you will not receive any future messages.
d. The Services and/or Software may not be available at anytime for any reason outside of the reasonable control of Fort Lee FCU or any service provider.
Privacy and User Information
You acknowledge that in connection with your use of the Services, Fort Lee FCU and its affiliates and service providers, including Fiserv, Inc. and its affiliates, may receive and may share with one another names, domain names, addresses, passwords, telephone and device numbers, the content of messages, data files and other data and information provided by you or from other sources in connection with the Services or Software (collectively "User Information"). Fort Lee FCU and its affiliates and service providers will maintain reasonable safeguards to protect the information from unauthorized disclosure or use, but reserve the right to use and disclose this information as reasonably necessary to deliver the Services and as otherwise permitted by law, including compliance with court orders or lawful instructions from a government agency, to protect the personal safety of subscribers or the public, to defend claims, and as otherwise authorized by you. Fort Lee FCU and its affiliates and service providers also reserve the right to monitor use of the Services and Software for purposes of verifying compliance with the law, these terms and conditions and any applicable license, but disclaim any obligation to monitor, filter, or edit any content.
Restrictions on Use
You agree not to use the Services and Software in or for any illegal, fraudulent, unauthorized or improper manner or purpose and will only be used in compliance with all applicable laws, rules and regulations, including all applicable state, federal, and international Internet, data, telecommunications, telemarketing, "spam," and import/export laws and regulations, including the U.S. Export Administration Regulations. Without limiting the foregoing, you agree that you will not use the Services and Software to transmit or disseminate: (i) junk mail, spam, or unsolicited material to persons or entities that have not agreed to receive such material or to whom you do not otherwise have a legal right to send such material; (ii) material that infringes or violates any third party’s intellectual property rights, rights of publicity, privacy, or confidentiality, or the rights or legal obligations of any wireless service provider or any of its clients or subscribers; (iii) material or data, that is illegal, or material or data, as determined by Fort Lee FCU (in its sole discretion), that is harassing, coercive, defamatory, libelous, abusive, threatening, obscene, or otherwise objectionable, materials that are harmful to minors or excessive in quantity, or materials the transmission of which could diminish or harm the reputation of Fort Lee FCU or any third-party service provider involved in the provision of the Services; or (iv) material or data that is alcoholic beverage-related (e.g., beer, wine, or liquor), tobacco-related (e.g., cigarettes, cigars, pipes, chewing tobacco), guns or weapons-related (e.g., firearms, bullets), illegal drugs-related (e.g., marijuana, cocaine), pornographic-related (e.g., adult themes, sexual content), crime-related (e.g., organized crime, notorious characters), violence-related (e.g., violent games), death-related (e.g., funeral homes, mortuaries), hate-related (e.g. racist organizations), gambling-related (e.g., casinos, lotteries), specifically mentions any wireless carrier or copies or parodies the products or Services of any wireless carrier; (v) viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information; (vi) any material or information that is false, misleading, or inaccurate; (vii) any material that would expose Financial Institution, any third-party service provider involved in providing the Services, or any other third party to liability; or (viii) any signal or impulse that could cause electrical, magnetic, optical, or other technical harm to the equipment or facilities of Fiserv or any third party. You agree that you will not attempt to: (i) access any Software or Services for which your use has not been authorized; or (ii) use or attempt to use a third party’s account; or (iii) interfere in any manner the provision of the Services or Software, the security of the Services or Software, or other members of the Services or Software, or otherwise abuse the Services or Software.
"Remote Check Deposit" will also be referred to as "RCD" or "Service" in this agreement.
"Business Day" is every Monday through Friday, excluding Federal Reserve Holidays.
"Check" may also be referred to as an "image" or an "item"
Use of Service
This service allows you to deposit checks into an eligible Fort Lee Federal Credit Union account from a remote location by capturing and transmitting an item electronically by using a compatible mobile device.  You may use this Service only for non-business, personal use in accordance with this Agreement. In order to use this Service, you must obtain and maintain, at your expense, compatible hardware. We are not responsible for the functionality or maintenance of any third party hardware or software you may need to use the Service.
This Agreement applies to consumer accounts only. The acceptance of this Agreement and use of the Service means you agree to all terms and conditions in this Agreement. Please read this Agreement carefully and keep a copy for your records.
Eligibility and Qualification Requirements
To qualify for this Service, you must meet Fort Lee Federal Credit Union’s eligibility criteria, including having all accounts in good standing.
Eligible Accounts
All consumer accounts are eligible for this Service except:
  • Estate Accounts
  • Trust Accounts
  • Organizational Accounts
  • Custodial Accounts
Limitation of Service
You may experience technical or other difficulties when using this service.  We do not assume liability for any technical or other difficulties experienced by you.  We reserve the right to change, suspend, or revoke services at any time without prior notice to you.  In the event this service is not available to you, you acknowledge that you can deposit your check at one of our branches, through a participating ATM, or by mail.
You agree that you will not use this Service outside of the United States.
Receipt of Disclosure
In the event you wish to receive copies of this or other electronic record on paper, please contact us by visiting a branch, writing to us at 4495 Crossings Blvd, Prince George VA 23875, or calling us at 804-452-0736.  At any point you may withdraw your consent to receive disclosures and notifications electronically, you will not be charged a fee if you choose to terminate receipt of notifications and/or disclosures via electronic means. 
Fort Lee Federal Credit Union does not charge a usage fee for this Service; however, we reserve the right to begin charging for this Service at any time.  If an item deposited by you is dishonored, rejected or otherwise returned unpaid, you agree that we may charge back the amount of the return to the account the check was originally deposited to and you will be assessed a fee in the amount shown on our current Fee Schedule for a returned check. If there are not sufficient funds in your account to cover the amount of the returned check, the account will be overdrawn and you will be responsible for payment. You agree that Fort Lee Federal Credit Union may debit any account maintained by you in order to obtain payment of your obligations under this Agreement. You acknowledge that wireless providers may assess fees, limitations, or restrictions. You agree that you are solely responsible for all such fees, limitations, and restrictions, and that we may contact you via your wireless device for any purpose concerning your accounts at Fort Lee Federal Credit Union, including but not limited to account servicing and collection purposes.
Deposit Limits
When using the Service to deposit funds, the aggregate amount of deposits cannot exceed $5,000 per business day with 3:00 pm EST as the cutoff time to submit an item for that day.  Any items submitted after 3:00pm EST will be processed with items received the following business day.  Each check must be submitted separately but you may submit multiple checks on the same day up to the daily limit.   
Deposit Items
You agree to scan and deposit only "checks" of which are defined as a negotiable demand draft drawn on or payable through a financial institution. 
You agree that you will not use this Service to scan and deposit any ineligible items including but not limited to the following:
  • Checks payable to any person or entity other than you
  • Post-dated or stale-dated checks
  • Starter or counter checks
  • Checks that have been altered, incomplete, or you know or suspect to be fraudulent.
  • Checks drawn off your Fort Lee Federal Credit Union account
  • Checks not payable in United States currency
  • Checks drawn on financial institutions located outside the United States
  • Consumer loans, credit card, and mortgage payments
  • IRA deposits
  • Money orders, travelers checks, Amex Gift Cheques, Savings bonds
  • Checks that require authorization
  • State-issued registered warrants
  • Checks previously converted to a substitute check
  • Checks that have been previously negotiated
  • Checks from another financial institution to a closed account
Endorsement Requirements
Before transmitting, you agree to endorse the back of all deposited items with your signature and print "For e-Deposit Only at Fort Lee FCU".  Fort Lee Federal Credit Union may reject all items missing either of these endorsements.
Image Quality
The image of the check transmitted to us must be clearly legible and must comply with all standards for image quality established by clearing house or any regulatory agency.
Receipt of Items
We reserve the right to reject any item transmitted through this Service, at our discretion. We are not liable for items we do not receive or for images that are not transmitted completely. An image is considered received when you receive an acknowledgement that the deposit has been accepted.  However, such acknowledgement does not mean that the transmission was without error. Once an item is reviewed and approved, you will see it in your account history.
Provisional Credit and Availability of Funds
Below is our general funds availability policy for this service:
If you receive a Deposit Approval Notification on Monday-Friday between 8:00 AM - 3:00 PM EST
  • Up to $200 of the check will be available next business day; with only one (1) $200 credit per day
  • Deposits in the amount under $5,000 will be available two business days from day of approval
If you deposit a check on Friday after 3pm or on a Federal Reserve Holiday, your deposit will be processed on the following Monday or business day.
Credit given for the item is provisional and subject to final approval of the item. Funds you deposit may be delayed for a longer period of time when we have reasonable cause to believe the check is uncollectable. We will notify you if we delay your ability to withdraw funds because we believe the check is uncollectable and we will tell you when funds will be available. You agree to receive all notifications regarding your use of this Service, including but not limited to exception notices as required by Regulation CC via electronic message. Please inform Fort Lee Federal Credit Union if you change your email address. With respect to each item you send to Fort Lee Federal Credit Union for deposit, you agree to indemnify and reimburse Fort Lee Federal Credit Union for and hold Fort Lee Federal Credit Union harmless from and against any and all losses, costs, and expenses.
Retention and Disposal of Items
You agree to retain each check for a minimum of five business days after your funds have been posted to your account. Upon receipt of these funds, you agree to mark the items prominently as "VOID" and to securely dispose of the item(s) in a way that prevents representing for payment. You agree to store each retained item in a secured container until such proper disposal is performed. You will promptly provide any retained item to Fort Lee Federal Credit Union as requested to aid in the clearing and collection process or to resolve claims by third parties with respect to any item.
Errors or Discrepancies
If you believe your statement is incorrect or you need further information regarding a transaction, please contact Fort Lee Federal Credit Union at 1-804-452-0736 as soon as possible. We must hear from you no later than 60 days after we sent the first statement on which the problem appeared. If you do not notify us within 60 days from the date your statement was sent, you may not be compensated for any losses.
Security Requirement
To prevent unauthorized usage of the Service, you agree to ensure the security of the personal computer and/or mobile device you own and use to access the Service. By securing these devices, we specifically mean installing operating system patches, antivirus software, firewall and spyware detection as applicable and keeping this security software current, as well as securing the physical device from theft or unauthorized use.
If you have authorized user(s) on your account, the user(s) will also have online access to the Remote Check Deposit Service. You and your authorized user(s) are equally responsible for adhering to all items disclosed in this Agreement.
Warranties and Indemnification
You warrant Fort Lee Federal Credit Union that:
  • You will only transmit eligible checks that you are entitled to enforce.  All checks will include all proper endorsements.
  • Images will meet Fort Lee Federal Credit Union’s image quality standards in effect from time to time.
  • You will not transmit an image of the same check to us more than once and will not deposit or negotiate, or seek to deposit or negotiate such check with any other party.
  • You will not deposit or represent the original check with Fort Lee Federal Credit Union or any other party.
  • All information you provide to Fort Lee Federal Credit Union is accurate and true, including that all images transmitted to Fort Lee Federal Credit Union accurately reflect the front and back of the check at the time it was scanned.
  • You will comply with this agreement and all applicable rules, laws and regulations.
  • You will use the Remote Check Deposit service only for your own deposits and will not allow the use of the Service by way of a service bureau business, timesharing, or otherwise disclose or allow use of the Service by or for benefit of any third party.
  • You agree to indemnify and hold harmless Fort Lee Federal Credit Union from any loss for breach of this warranty provision or the terms of this agreement.
Fort Lee Federal Credit Union representations, warranties, obligations, and liabilities and your rights and remedies, set forth in this Agreement, are exclusive. The software is provided by Fort Lee Federal Credit Union and its licensors "as is" and on an "as available" basis. We disclaim all warranties of any kind as to the use of the services, whether expressed or implied, including but not limited to the implied warranties of merchantability for a particular purpose.
We make no warranty that:
  • the services will meet your requirements
  • the services will be uninterrupted, timely, secure, or error free
  • the results that may be obtained from the service will be accurate or reliable
  • any errors in the services or technology will be corrected
Fort Lee Federal Credit Union’s liability for errors or omissions with respect to the data transmitted or printed by Fort Lee Federal Credit Union will be limited to correcting the errors or omissions.
Change in Terms
Fort Lee Federal Credit Union reserves the right to change the terms and conditions of this Service or terminate this Agreement without notice at any time.
Governing Law
This Agreement supplements the terms of your Membership and Account Agreement. Together they constitute the entire Agreement between you and Fort Lee Federal Credit Union with respect to the services. This Agreement is governed by Fort Lee Federal Credit Union bylaws, including applicable principals of contract law, and regulations of the State of Virginia, and local clearinghouse rules, as amended from time to time. A determination that any provision of this Agreement is unenforceable or invalid shall not render any other provision of this Agreement unenforceable or invalid. Unauthorized use of this Service is strictly prohibited.
